Terms of Service

These Terms of Service (“Terms”) govern your use of NextGen Academy (the “Service”), an educational games platform for children operated by SAM Media B.V., Van Diemenstraat 356, 1013 CR Amsterdam, Netherlands (“we”, “us”). By subscribing to or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

NextGen Academy provides interactive learning games and activities across subjects including math, science, English, geography, logic and art. The Service is provided on a subscription basis and is intended to be used by children under the supervision of a parent or guardian.

2. Eligibility & parental consent

The Service is designed for children, but subscriptions may only be purchased by an adult (18+) who is the account holder of the mobile number used to subscribe. By subscribing you confirm you are the authorised bill payer for that mobile number and consent to your child’s use of the Service.

3. Subscription & billing

The Service is provided as a subscription billed through your mobile carrier (direct carrier billing). By subscribing you authorise recurring charges to your mobile account by your mobile operator until you cancel. Charges continue on a renewing basis until you cancel.

4. Cancellation

You may cancel at any time. Cancellation stops future renewals; see our Refunds & Cancellation policy for details, or contact support@nextgen-academy.ai for help.

5. Acceptable use

You agree not to:

• Copy, resell, or redistribute the Service or its content;
• Attempt to circumvent billing, access controls, or security;
• Use the Service for any unlawful purpose.

6. Intellectual property

All content, games, graphics and software in the Service are owned by SAM Media B.V. or its licensors and are protected by intellectual-property laws. You receive a personal, non-exclusive, non-transferable licence to use the Service for the subscription period.

7. Disclaimers & liability

The Service is provided “as is”. To the maximum extent permitted by law we exclude implied warranties and are not liable for indirect or consequential loss. Nothing in these Terms limits liability that cannot be limited by law.

8. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified through the Service. Continued use after changes take effect constitutes acceptance.

9. Governing law

These Terms are governed by the laws of the Netherlands, and disputes are subject to the courts of the Netherlands.
